The Core Statutes: Your Regulatory North Star
Nurses in Ontario must operate within a triad of legislation to ensure care is lawful and ethical:
Mental Health Act (MHA): Governs the admission of clients to psychiatric facilities, their detention, and their rights while hospitalized.
Health Care Consent Act (HCCA): Focuses on the capacity of a client to make treatment decisions and the role of substitute decision-makers.
Substitute Decisions Act (SDA): Outlines the legal requirements for managing the property and personal care of individuals who are determined to be incapable.

A doctor has examined a client in the community and believes they are a danger to themselves; they require a 72-hour assessment.
Form 1: Application by Physician for Assessment
A family is fearful for a client's safety and goes to a Justice of the Peace to request an assessment because the client refuses to see a doctor.
Form 2: Order for Examination
After a 72-hour hold, a psychiatrist determines the client is still a danger to others and must be admitted involuntarily for up to 14 days.

The Spectrum of Admission: Voluntary vs. Involuntary
The nurse must clearly communicate the difference in status to every client upon admission.
Voluntary Admission: The client agrees to treatment and is not an immediate threat. They are free to leave, provided they remain safe.
Involuntary Commitment: A legal process where a client is held against their will because they are deemed a danger to themselves or others. This is typically initiated by a Form 1 (72-hour hold).

Patient Rights & Advocacy
Admission on a legal form does not suspend human rights. In Ontario, nurses must facilitate the following:
Rights Advice: Clients on specific forms (like Form 3) must be notified of their right to a hearing by the Psychiatric Patient Advocate Office (PPAO).
Legal Counsel: All clients have the right to speak with a lawyer at any time, even while on an assessment hold.
Confirmation of Rights: Nurses must ensure a Form 50 is present in the chart to confirm the patient was advised of their rights.

Privacy: PHIPA & The "Circle of Care"
Under the Personal Health Information Protection Act (PHIPA), we have a mandate to safeguard client data.
The Circle of Care: Personal health information (PHI) can be shared among the immediate healthcare team involved in the client’s care without explicit consent.
External Disclosure: Information cannot be released to family members or external agencies without the client’s informed consent unless a legal exception applies.
The Duty to Warn: A critical exception; if a client poses a serious, credible threat of harm to a specific individual or the public, the healthcare team is legally mandated to notify the authorities and the threatened party.
